OSHA Updates 

  • The Heat Illness & Prevention Rule – If you work in California, there is now an indoor heat rule.  Put out notice of rule-making in October 2021.
    • This is a priority for the current administration
    • Typically protocols for access to drinking water.  Regulating how much water is on site.  
    • Designated shade 
    • Designated break times
    • Health monitoring
    • Emergency Response
  • The Worker Walkaround Designated Process (coming out in May 2023)
    • Could have a Union representative onsite during OSHA walkarounds
    • Following in the footsteps of  the “OSH Act”  which was originally a backdoor way to unionize
    • Anticipate it will come out as a regulation in May
    • Union representatives can be deemed as “necessary”
    • Fairfax Memo
    • Once it comes out, the notice of proposed rulemaking will have a comment process.  It is recommended that organizations that are opposed to  this rule comment on this action.
  • Interim rule to provide clarity on their subpoena power
    • No current draft
    • OSHA will propose that this take effect without time for comment
    • OSHA has not put forth the reason for not allowing comment on this
    • Recurring issues on documentation
    • Will come out as an administrative subpoena
